Your agreement for using Fit PA's AI training services

1. Service Agreement

By using Fit PA, you agree to these Terms of Service ("Terms"). Fit PA is an AI-powered personal training assistant provided by Carian Solutions Inc. ("we," "our," or "us"). Our Service is designed to enhance your athletic performance through intelligent data analysis and personalized recommendations.

If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

To use Fit PA, you must:

  • Be at least 16 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. Subscription and Billing

Fit PA offers subscription-based access to our Service:

  • Subscription plans and pricing are displayed at the time of purchase
  • Billing occurs automatically on your subscription renewal date
  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period

Refund Policy

  • 30-day money-back guarantee for new subscribers
  • Pro-rated refunds for annual plans canceled within 60 days
  • No refunds for partial months or unused features after the guarantee period
  • Beta access is free and not subject to billing terms

5. Acceptable Use Policy

You agree to use Fit PA for its intended purpose of athletic training and performance optimization. You may not:

  • Share your account credentials with others
  • Attempt to reverse engineer, decompile, or extract source code
  • Use the Service for commercial purposes without authorization
  • Manipulate or falsify training data
  • Interfere with the Service's operation or security
  • Violate any applicable laws or regulations

6. AI Recommendations and Health Disclaimers

Important: Fit PA provides AI-generated training recommendations based on data analysis. These suggestions are not medical advice and should not replace consultation with healthcare professionals, certified trainers, or sports medicine specialists.

You Acknowledge That:

  • AI predictions are estimates based on available data and may not be accurate
  • Training recommendations should be evaluated based on your individual health status
  • You should consult a physician before starting any new training program
  • You assume full responsibility for your training decisions
  • Fit PA is not a substitute for professional medical or training advice

7. Limitation of Liability

To the maximum extent permitted by law:

  • Fit PA is not responsible for injuries resulting from training recommendations
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • We do not warrant uninterrupted or error-free service

8. Intellectual Property

Fit PA's AI algorithms, software, user interface, and proprietary technology are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal training purposes only.

You may not:

  • Copy, modify, or distribute any part of the Service
  • Use our trademarks without written permission
  • Create derivative works based on the Service

9. Your Content and Data

You retain ownership of your personal training data. By using the Service, you grant us a license to use your data as described in our Privacy Policy to provide and improve the Service.

10. Device Integration and Compatibility

While Fit PA strives to maintain compatibility with leading fitness devices, we cannot guarantee:

  • Continuous integration with all third-party hardware and software
  • Compatibility with future device updates or new devices
  • Accuracy of data from third-party devices

Device compatibility may change due to manufacturer updates or policy changes beyond our control.

11. Service Availability

We aim for 99.9% uptime but cannot guarantee uninterrupted service. We are not liable for:

  • Scheduled maintenance (announced in advance when possible)
  • Service interruptions due to circumstances beyond our control
  • Third-party service outages affecting integrations

12. Termination

Either party may terminate this agreement at any time:

  • You may delete your account through settings or by contacting support
  • We may terminate your access for violation of these Terms
  • Upon termination, your access to Fit PA will cease
  • You may export your personal data for 30 days following account closure

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the new Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.
